韓國首爾2020年10月13日 /美通社/ -- 作為基於韓國玩具公司Choirock Contents Factory Co., Ltd.自有專利技術開發的玩具品牌，Mecard在與加拿大全球玩具公司Spin Master, Ltd.的所有全球專利糾紛中大獲全勝。

2018年，Spin Master起訴了美國、加拿大和澳大利亞等地的美國玩具公司Mattel, Inc.，宣稱Mecard玩具侵犯了Spin Master的「爆丸」專利。Mattel經Choirock許可在上述國家經銷Mecard玩具。而Spin Master的訴訟阻礙了Mecard進入國際市場。

2019年3月，為應對Spin Master的訴訟，Choirock向美國專利審查與上訴委員會（PTAB）遞交了雙邊複審申請，質疑Spin Master的三項美國「爆丸」專利的有效性。Spin Master宣稱Mecard侵犯了上述三項專利。2020年9月，PTAB裁定所有受質疑的各項「爆丸」專利不具備專利性。PTAB對受質疑的多個同族專利做出無效裁決，這種情況實屬罕見。上述裁定確認因為Spin Master的「爆丸」專利不過是先前開發的或已知的玩具技術，所以缺乏專利要件，使Choirock獲得了全面勝利。

在此之前，某意大利法院（歐盟）和中國最高法院也分別裁定Spin Master的歐盟專利不具備專利性及「Mecard」玩具未侵犯Spin Master的中國專利權。意大利米蘭法院特別提出Spin Master的歐盟專利核心要求與其在其他訴訟中所採用的一樣，都不具備專利性。Choirock在Spin Master向中國最高法院提出的專利侵權訴訟中也同樣拿到了勝訴判決。在中國勝訴證明「Mecard」專利具備與「爆丸」專利完全不同的創意與原創性。因此，Choirock已經成功清除了「Mecard」玩具全球業務中與Spin Master「爆丸」專利相關的全部障礙。「Mecard」玩具採用的是一種獨特的玩具變形機制，可以舉起玩具卡片，從而讓卡片底面顯露出來。這一機制在全球尚屬首創。
